柿の木は残った
Highfieldの脇には、柿の木がありました。Happy Farmer一家の耕作地に植えられたものですが、枝はHighfieldに侵略して伸びていました。3K Wiffyは、Highfieldに伸びてきた枝の柿は採って食べていました。（これは法的にも許されています。）Happy Farmer一家が、柿を収穫することはなく、ただ腐らせて鳥の餌になっていたためです。しかし、この柿はスーパーで売っているものとは比べ物にならない、甘くておいしい柿でした。
There was a persimmon tree beside Highfield. It was planted in the Happy Farmer Family's cultivating land, but the some extended branches invaded Highfield. 3K Wiffy used to eat the persimmons on the branches that had grown to Highfield. (This is legally acceptable.) This is also because the Happy Farmers did not harvest the persimmons, and left them to be just rotten and eaten by birds. However, this persimmon was sweet and delicious, which is not comparable to what is sold at supermarkets.
この柿の木は、新しく購入して増やしたHighfieldの土地に入っていたため、どうするかが問題となりました。考えられる選択肢は以下でした。
As this persimmon tree is in the newly purchased land of Highfield, it became a problem how to deal with it. Possible options were as following.
a) Happy Farmer一家が、別の場所に移植する。
The Happy Farmer Family transplants it to another place.
b) このままにしておくなら、If they leave it as it is,
１．土盛りをする位置にあるので、3K Wiffyが他の場所に移植する。
3K Wiffy transplants to other place, because it is in a position for
an artificial hill.
２．伐採する。
Cut it down.
３．幹が2股になって成長しているので、斜めに伸びている副幹を切って主幹だけ
残す。主幹も下枝を切って、土盛りをしても、全て土の上に出るようにする。
Since it is growing into two trunks, cut the diagonally extending side trunk
and leave the main trunk. Also cut the lower branches of the main trunk,
then even when the soil is piled, the whole tree will be above the ground.
Happy Farmer一家は片づけにすら来ていなかったので、柿の木のことも当然返事はありませんでした。不動産屋さんからも、作物補償料は払っているので、購入した土地にあるものは自由にしてよいと言われました。当初は、Highfield内の別の場所への移植を考えていましたが、これは費用がかかるのと、移植しても夏は時期が悪いので、まず枯れてしまうということで止めました。おいしい柿なので、伐採もかわいそうだし、３の方法を取ることにしました。剪定してコンパクトにすれば、埋めても生き残る可能性が高いそうです。
The Happy Farmers did not even come to clean up, so, naturally there was no reply about the persimmon tree. Since the crop compensation fee was being paid, the estate agency said that what is on the purchased land may be dealt however we wanted. At first, 3K Wiffy was thinking of transplanting it to another place in Highfield. However, the cost was not cheap, and if transplanted, the tree would die because summer is not good timing to do so. Felling was pity, because it is delicious. She decided to take the way No.3. If it is made compact, it is likely to survive even if lots of the parts buried under the soil.
剪定作業も業者にお願いすると費用がかかるので、3K Wiffyが汗をかきながら自分でやりました。
Pruning also would cost some money if we asked the builders. 3K Wiffy did it herself while sweating.
これは、後で、造成業者から聞いた話です。工事開始の日、Happy Farmer一家との片づけの最中、彼らは業者の手伝いの同級生に、「柿の木をブルドーザーでがばっと掘って自分たちの耕作地までがばっと移植してくれないか」と頼んだそうです。同級生はOKと言いかけたのですが、それを聞いていた業者の社長が「費用は誰が払うんですか？」と聞くと、「お金がかかるなら柿の木はいいや」となったそうです。危うく3K Wiffyの汗が無駄になるところでした。社長は、3K Wiffyが残そうと、せっせと剪定していたのを知っていたので、機転を利かせてくれたのです。実は、この片づけ作業一式は、不動産屋さんが払うことになっていたので、業者は不動産屋さんに請求することも出来たのです。
This is a story I heard from the builder later. On the day of the construction start, during the tidying up with the Happy Farmers, they asked the old classmate construction assistance; "Will you dig up the persimmon tree with the bulldozer and transplant it to our cultivating land?" The classmate nearly said OK, but as the president of the company was listening to it and asked them, "Well, Who pays for that?". They said, "If it costs money, we don't need the persimmon tree." It was a close shave. The 3K Wiffy's sweat was nearly to be wasted. The president knew that 3K Wiffy had been pruning it to let it survive, so he made the trick on them. In fact, since the estate agency was supposed to pay this clearing work, the builders could also charge the cost to the estate agency.

Happy Farmer一家（同級生）
6月25日、Highfieldの造成工事の始まりの日、朝の８時半です。外から「だから、それやるように言われてたんだろ。」「お前はうるせんだよ。わかったから、今やってるだろ。」「そんで、これどこに動かすんだ。」「使ってないビニールハウスの枠の中にでも入れようか。」という声が聞こえて来ます。見ると、Happy Farmer一家の若いお兄さんと、造成業者の若いお兄さんが、Highfieldの周りの積年の廃材を動かしています。工事が始まっていました。
It was 8:30 am, June 25th, the day of beginning of the construction of Highfield.
From outside, "You were told to clear these." "Stop annoying me. I knew, so, I'm doing it now." "Well, where to put this?" "Let's put it under the frame of the unused greenhouse." I heard two voices. A young brother from the Happy Farmer Family and a young man from the building company were moving the long-time neglected wastes around Highfield.
The construction had begun.
造成業者の社長が、廃材のことで3K Wiffyに確認に来ました。その時事情を聞くと、なんと、工事の手伝いを頼んだお兄さんとHappy Farmer一家のお兄さんが同級生だったそうです。昨日、現場の確認をした際、廃材がそのままになっていたので、同級生くんがFarmerくんに今朝電話して、Highfieldに来て一緒に片づけるよう、呼んだそうです。
The president of the building company came to 3K Wiffy to confirm about the waste materials. Without a moment's delay, 3K Wiffy asked about this miracle change to the president, and found that the young man hired as the construction assistance and the young brother of Happy Farmer Family were once classmates. When the building company checked this site yesterday, the wastes were still left unchanged. So this assistant builder phoned the Happy Farmer brother this morning and asked to come to Highfield Immediately and clean the wastes together.
不動屋さんが頼んでも生返事で、お金は受け取って納得したと言っても、動かなかったHappy Farmer一家も、同級生に言われると動いたのです。^_^v.
The Happy Farmers has given halfhearted replys to the request from the estate agency. They did not act even when they received the consolation money saying 'understood'. But the Happy Farmer brother moved when he was asked by his old classmate. ^_^v
造成業者の廃材にことでの確認とは、3K Wiffyの計画では、廃材の一部のコンクリートの平板を庭の造成に使うようにしていたためです。この廃材はC市がHighfieldの前の道路に排水溝をつけてくれた時に出た、古い土留めに使用されていた材料です。Happy Farmer一家が、C市が片づけようとするのを、何かに使えるかもしれないからと、置いて行ってもらったものです。でも、その後５年以上まったく放置されて、Highfieldの周りの他の廃材と一緒に、出入りの邪魔になっていました。要らないのであれば、この廃材の平板を利用して、庭に作る築山の土留めにしたり、駐車場のわだちの下に敷こうと、計画していました。
The confirmation on the waste materials by the builders was related to the 3K Wiffy's garden plan. She wanted to use some concrete boards in the wastes for the garden creation. This waste materials were the left one when C-City made a drainage ditch in front of Highfield. These were the materials used for old earth retaining. C-City tried to clear them, but the Happy Farmer family asked to leave them because they might come to be useful. But, they were totally neglected over for 5 years. Along with other wastes around Highfield, they were the disturbance of going in and out. If they were not necessary for Happy Farmers, 3K Wiffy was planning to use the concrete boards for earth retaining of a little artificial hill in the garden and also for paving under a car park.
3K Wiffyが、Happy Farmer一家のお兄さんに、廃材をもらってもよいかと確認すると、「使うかもしれないからあげない」と言われました。>_<
When 3K Wiffy asked the Happy Farmer brother if she could get the waste, he said, "I can't give you because I might use them." >_<
結局、Highfieldの周りの廃材は、工具の壊れたものは、ビニールハウスの枠組みの下に移動され、ビニールごみは後からやって来たHappy Farmer一家の他の家人がトラックに積んで持って帰り、コンクリート廃材は、延長したHighfieldの土地のまたすぐ脇に、今度は業者さんによりきれいに積み上げられました。またきっと、この先何年もただ積み上げておくのでしょう。
After all, broken tools were moved under the framework of the greenhouse, vinyl or plastic wastes were brought back by a truck by another members of the Happy Farmer Family who came later, and concrete materials were piled up again next to the extended Highfield land, this time neatly by the builders. Surely they will just be stacked for years to come.
アロットメントとHappy Farmer一家の耕作地を仕切っていた緑の網のフェンスも、Gaijinsanと3K Wiffyの土地の内側の部分は、撤去されました。Happy Farmer一家がそれをしっかり手伝っていたのは、驚きの見ものでした。
The green net fence that divided the allotment and Happy Farmers' land, in the inner part of the 3K Wiffy's land, has also been removed. It was a surprising sight to see that the Happy Farmers was helping this removal well.
アロットメント側の、新しく造成された土地の丘の斜面に放置されていた古い草生したトラクターも、Happy Farmer一家の耕作地の中に片づけられました。心配して、様子を見に来てくれた不動産屋さんも、「よかった。そうか、同級生か。私も昨日電話したんだ。よかった。」と安どしていました。Gaijinsanと3K Wiffyの土地のことだけでなく、造成地を買ってくれた方からも、トラクターを片づけてくれと言われていたそうです。
A old grassy tractor, that had been left on the slope of the newly built land on the allotment side, was also moved up in the Happy Farmers' land. The worried estate agency also came to see the situation, and was really relieved. "Good! I see, his old classmate persuaded. I phoned yesterday, too, but their answer was not Cooperative." His worry was not only for the land of Gaijinsan and 3K Wiffy, but for the land beside the slope, which was newly bought. The people who bought a block there told him to clean up the tractor.
こうして、Happy Farmer一家が片づけに参加してくれたおかげで、この先文句が出ることはもうないでしょう。造成業者が勝手に片づけていたら、何を言ってくるかわからない人たちです。3K Wiffyは、コンクリート廃材の代わりに、また知恵を絞ればよいのです。
Thus, thanks to the Happy Farmer family participating in the clean-up, there will be no worry for more complaints from them. They are the people who would say anything if the builders had cleared up without permission. For 3K Wiffy's garden plan, instead of the concrete boards, she can think of some other ideas.
工事は、雨に悩まされながらも、どんどん進んでいます。
The construction is progressing steadily while being delayed by rain.
１週間後の７月１日に、C市の固定資産税課の担当の方が、見回りに来ました。こういう案件の場合、結局いつまでも造成できず、ずっとそのままになっているケースも多いそうで、その後の様子を見に来てくれたのです。土留めの工事を見て、「これなら来年は、１つの宅地として見れるかな。」と言ってくれました。
One week later, on July 1st, the person from the land property tax section of C-City came to see. Happy Farmer一家（その後）
Happy Farmer一家には、農業委員会も認めているので、「元には戻せない」ということは理解してもらえました。Gaijinnsanと3K Wiffyの不動産屋さんも、登記も済ませているのだからと、説得にがんばってくれました。交渉を重ねるうちに、Happy Farmer一家のぐずりもだんだん理由がはっきりしてきて、それをまとめた交換条件が出て来ました。「Highfieldの南側の5m幅の購入した土地の代わりに、その部分の1.5倍の大きさの土地を西側の購入地にプラスするので、交換して欲しい。」というものでした。南側の土地は、トラクターの進入に使うのでキープしておきたいという理由です。
As the agricultural committee approved the purchase, the Happy Farmer Family understood that it could not be undone. The estate agency of Gaijinnsan and 3K Wiffy also tried to persuade the Happy farmers that we have officially registered the land. As the negotiations progressed, the reasons of Happy Farmers' dissatisfaction became more clear, and the terms and conditions for exchange came out; which was "Instead of the purchased land on the south side of Highfield (5m wide, 13m long), they want to replace it with a Land of 1.5 times in size on the west side." The land on the south side was used for the approach of their tractor, so they wanted to keep it.
でもこの交換売買は、この土地の緑地制限の30年の期限が終わる4.5年後先にしか実現出来ないのです。この緑地制限は、大地主様のお父様の代にC市に登録したことですが、一旦、代変わりを理由にアロットメントの側とGaijinnsanと3K Wiffyの買ったHappy Farmer一家の耕作地の端っこの部分は緑地制限を外したので、残った他の土地は、もう期限の終わりまで動かせません。この交換条件を呑めば、Gaijinsanと3K Wiffyは、4.5年間、土地の造成は一切出来ず、ただ交換を待たなくてはならなくなります。4.5年は長いです。
But this exchange can only be realized 4.5 years after at the end of the 30-year period of production green land restriction. しかし、納得してもらうためには、譲歩も必要です。ただ、3K Wiffyは、南側は、特に土地が狭く、家と畑の間が数十センチしかないので、せめて1.5mくらいはこのまま確保したいと思いました。5mから1.5m引いて、3.5mの幅になっても、トラクターは進入出来ることを確認しました。こちらのこの1.5m条件を呑んでくれるなら、交換まで待ってもよいと歩み寄りましたが、Happy Farmer一家は、どうしても南側は全部欲しいと譲りませんでした。
Anyway, a compromise is also necessary in order to convince the Happy Farmer Family. But, 3K Wiffy wanted to keep at least 1.5m at the south side. On the south side, the Highfield land is particularly narrow, with only a few dozen centimeters between the house and the field. She checked that a tractor could enter even if it became 3.5m width by subtracting 1.5m from 5m. If the Happy Farmers leave 1.5m wide land for her, 3K Wiffy thought that she could wait until the exchange. But, the Happy Farmers did not agree to this and insisted all south side.
土地の人たちから話を聞くと、このHappy Farmer一家は、地元でも傍若無人な迷惑行為で有名な農家でした。この地域に点在する畑で耕作していて、畑の周辺の人たちから、「トラクターでフェンスを壊されたが、何もしてくれず、結局自分で直した。」とか、「畑の隣の空き地に勝手に工作機械を置いておく。」とか「朝６時から、トラクターを運転するので、睡眠妨害だ。」とか「収穫した後のキャベツやブロッコリーをそのままにしているので、腐ってひどいにおいがする。」という苦情を聞いています。
According to the local people, this Happy Farmer family was famous for being arrogant and annoying. They cultivate the fields scattered in this area and people complain; "The Happy Farmers broke my fence with a tractor, but they didn't do anything and eventually I fixed it myself.", "The Happy Farmers keep the tractors on the vacant land next to the field without permission.", "The Happy Farmers drive the tractor from 6 am. It is a sleep disturbance.", and "As The Happy Farmers leave cabbages and broccolies after harvest, those vegetables become rotten and smell awfully."
また、Happy Farmer一家の交換条件は、彼らが大地主様より交換分の土地を4.5年後に購入して、始めて成立するのですが、その購入費用の出所が、当てにならないこともわかって来ました。交換条件で、期限を引き延ばし、その間自由に使って、4.5年先が来たら、またぐずぐず言い出す可能性も出て来たのです。
Also, the terms of exchange with the Happy Farmer family will come true when they purchase the land for the exchange from the landlord after 4.5 years. But we are informed that their source of the purchase cost is not very reliable. There was a possibity that the Happy Farmers extend the time limit with the terms of the exchange, while using the land freely, and 4.5 years later, they say difficulties again.
Gaijinnsanと3K Wiffyは、当てにならない話に振り回されるのは嫌なので、交換条件は受け付けないことに決めました。
Gaijinnsan and 3K Wiffy decided not to accept the terms of the exchange, as they do not want to be swayed by unreliable promises.
しかし、Happy Farmer一家はぐずぐず言い、新しく設置されていた境界の杭も抜いてしまう始末でした。刑法には「境界標を損壊し、移動し、若しくは除去し、又はその他の方法により、土地の境界を認識することができないようにした者は、5年以下の懲役又は50万円以下の罰金に処する」となっています。このため一旦は、裁判所による調停、Happy Farmer一家が調停に出てきてくれなければ裁判にする、という話にもなりました。費用は、不動産屋さん持ちです。（Happy Farmer一家との決着については、3K Wiffyが土地の購入契約に記載してもらっていました。）Gaijinnsanと3K Wiffyは、弁護士さんにも会って、裁判の準備をしていました。裁判になれば、こちらの勝訴は間違いありません。
However, the Happy Farmer family still complained and even pulled out the newly installed boundary mark stakes of 3K wiffy's purchased land. It is supposed to be treated, according to the Penal Code, "those who have broken, moved or removed border marks, or otherwise made them unable to recognize land boundaries are subject to five years in prison or a fine of up to 500,000 yen." Gaijinnsan and 3K Wiffy decided to go for the court mediation, and if the Happy Farmers do not appear in the mediation, go for the court trial. The expenses are promised by the estate agency. (3K Wiffy asked to state in the land purchase contract about the settlement with the Happy Farmer family.) Gaijinnsan and 3K Wiffy met a lawyer and were preparing for the trial. If we go to the trial, there is no doubt that we will win this case.
が、不動産屋さんが、昔からここにいる家族だからと、またがんばって仲裁してくれて、結局裁判にかかる分くらいのお金を包むことで、解決となりました。
But, the estate agency continued to do their best, as the Happy Farmer Family is an old family here. In the end, it was settled by giving them some money. The amount was about the cost for the trial.
Gaijinnsanと3K Wiffyは、購入した敷地を造成出来ることになりました。明日6月25日から造成に入ります。Happy Farmer一家にも伝えて、期日までに、廃材の片づけ、作物の収穫、置きっぱなしのトラクターの移動をお願いしました。
Gaijinnsan and 3K Wiffy is now able to do the land forming on the purchased land. It will start tomorrow on June 25. The Happy Farmer Family was informed the date and asked to clean up the waste, harvest the crop and move the tractor by the due date.
でもHappy Farmer一家は、廃材は片づけないし、いまだトラクターは置きっぱなしにしています。とうもろこしだけ、収穫に来ました。
But, the Happy Farmer family did not clean up the waste. The tractor is still in place. They have only come to harvest the corn...
明日はどうなるのでしょうか？

Happy Farmer一家の物言い
大地主様の土地の半分、アロットメントではない方の土地、緑の網のフェンスの反対側は、Happy Farmer一家が借りて耕作しています。春は、菜の花と周囲の木々の青葉で大変きれいで、見る人の目と心を癒してくれます。Highfieldからは、南側の窓を開けると緑の田園風景を楽しむことが出来ます。でも、・・この田園風景には、ちょっとした落とし穴もありました。
The half of the landlord' land, the non-allotment, the other side of the green net fence, is cultivated by the Happy Farmer Family. This land is very beautiful in spring, with rape flowers and the new green leaves of surrounding trees, which heals your eyes and mind. From the windows of Highfield, you enjoy this beautiful scenery. But,... there was a pitfall in this pastoral landscape.
Gaijinsanと3K Wiffyは、こっち側の土地も、Happy Farmer一家が耕していなかった端の部分を購入し、三角だったHighfieldの土地を四角に広げました。この耕していなかった部分には、Happy Farmer一家が古い農機具や廃材を置きっぱなしにしていたので、それをきれいに片づけて、家の周りをすっきりさせる目的もありました。廃材の放置のために、Highfieldは角度によっては「ごみ屋敷の始まり」に見えていました。
Gaijinsan and 3K Wiffy also bought the edge of this Happy Farmers' side, and extended the Highfield's land from the triangle shape into a square shape. Since the Happy Farmer Family had not plowed this edge and left broken agricultural machineries and scraps in the area, it also had the purpose of tidying and cleaning up the surroundings of Highfield. Highfield was seen, from some angles, as "the beginning of a Garbage House" due to these left wastes.
Happy Farmer一家は、大地主様と小作権の契約を結び、年間５万円の耕作料を払っているそうです。この小作権の契約は、借りている側がOKしないと解約は出来ないので地主様は勝手に土地を売ったり他の人に貸したりも出来ません。しかも、この小作権は代が変わっても相続出来るので、小作権付の土地は、大地主様のものでも大地主様が自由に出来ない土地なのです。マッカーサー元帥が農地改革により制定した制度です。
The Happy Farmer Family made a contract of tenant rights with the father of the present landlord and has paid the annual fee of ¥ 50,000. This tenant rights can not be canceled unless the tenant farmer approves it, so the landlord can not sell the land or lend it to others. Moreover, since this tenant rights can be inherited even when the generation changes, the land under tenant rights is the land even the landlord can not do anything. It is a system established by the General MacArthur after the World War Second for the agricultural land reform.
ではなぜ、Gaijinsanと3K Wiffyは、この土地の１部を買うことが出来たのでしょうか？それは、購入の話が出た時に、この小作権契約の書類がC市の農業委員会では見つからなかったためです。そのため単なる土地の賃貸契約だったと解釈され、（とにかく昔の話なので誰もよく覚えておらず）彼らは地主様より土地を買い、登記も済ませることが出来ました。その後で、なんということでしょう、農業委員会の担当係の隣の係の書庫から、小作権契約の書類が出てきたのです。
So, why could Gaijinsan and 3K Wiffy buy a part of this land? That is because the document of this tenant rights contract was not found at the Agriculture Committee in C-City when they came to buying. Therefore, the contract with the Happy Farmers was interpreted as just a lease contract for land, (it was anyway an old story, so nobody remembered well), so Gaijinsan and 3K Wiffy could buy the land from the landload and completed the land registration. After that, Oh my goodness!, there came out the document of tenant rights contract from the neighbour section of the section in charge in the Agricultural Committee.
農業委員会のHappy Farmerへの説明（言い訳）は、「この部分は耕作されていなかったので、小作権は及ばない。そのため、売買を許可した。」というものでした。でも、Happy Farmer一家はそのまま納得しませんでした。
The explanation (excuse) from the Agricultural Committee to the Happy Farmer Family was: "This part of the land was not cultivated by you, so this part was not covered by the tenant rights. Therefore, buying and selling is permitted." But the Happy Farmer family was not convinced...
攻防が始まりました。

密航おばあさん
毎日、散歩に家の前の道を歩いて、一休みにブロック塀に腰かけ、Happy Farmer一家の人たちと話して行くおばあさんがいます。彼女は、Highfieldに自生して来る、アロットメント時代の根っこからの大根とかを見つけると、無邪気に「取っていいか」と聞きます。もちろん、「勝手に掘って行ってくれ」と答えています。彼女は自称「密航者」です。でも、日本人で生まれは神戸だそうです。密航とは沖永良部島からだそうです。どういうことかわかりますか？
There is a grandmother who takes a walk everyday on the lane in front of the Highfield, sits down on a block fence for a break, and talks with the Happy Farmer family. When she finds a radish grown from the left roots in the allotment, she asks 3K Wiffy innocently, "Can I take it"? 3K Wiffy replys ''Of course, please dig it out." She is a self-proclaimed "smuggler". However, she is a Japanese and was born in Kobe. Her 'smuggling' seems to be from Okinoerabu Island. Do you see what this means?
3K Wiffyは昭和生まれなので、思い出しました。そう、沖縄周辺の島々は戦後一時期「外国」だったのです。彼女は小学校の時の夏休みに、親戚のいる沖永良部島に行き、いたく気に行ったので、そのまま２０歳までうっかりそこで過ごしてしまったそうです。大人になって、でも島には仕事もないので本土に帰ろうとしたら、帰るにはパスポートが必要になっていました。沖永良部島にいた間に、日本は戦争に負けて、そこは「外国」になっていたためです。でも、彼女の住民票は沖永良部島にはないので、パスポートは作れません。・・帰るには密航しかなかったのです。
3K Wiffy was born in Showa era, so she remembered. Yes, the islands around Okinawa were "foreign" for a while after the war. The grandmother went to Okinoerabu Island where her relatives were living, during her summer vacation of an elementary school. She became so fond of the place that she carelessly stayed there until the age of 20. She grew up, but there was no work on the island, so she wanted to return to the mainland. But she needed a passport to go back, because, while she was in Okinoerabu island, the island became "foreign" because Japan had lost the war. But her residential record was not able to obtain on Okinoerabu island, so the local government could not issue her passport. The only way to go back was by smuggling.
彼女は神戸に戻らず、知り合いを頼って千葉に来ました。竹中工務店で仕事に就いたのですが、でも住民票が提出できず、惜しまれながらも辞めざるを得なかったそうです。その後上手にやってくれた小さな会社があって、住民票も作って、ちゃんと就職したそうですが、竹中工務店のことは実に惜しかったと言っています。
She did not return to Kobe, but came to Chiba relying on her acquaintances. She got a job at Takenaka Corporation, but she could not submit her resident card, and she had to give up the job even though the company wanted her. After this, there was a small company that did a kind job for her; she found a proper job there and made a resident card with the help of the company. But, she still says that Takenaka Corporation was really pity.
彼女はHappy Farmer一家とは長い付き合いのようで、「一家のおじいさんのお嫁さんは大変きれいな人で、若い時はよく農作業のお昼に一緒におにぎりを食べたり、Highfieldのある丘を一気にふもとの家まで競争で駆け下りたりもして、・・とても楽しかった。」と語ってくれたこともありました。この辺りには当時まったく家などなく、生浜東小学校（当時は中学校）と、７廻り塚（今は生浜東小学校の校庭）と、Highfieldの前にある日露戦争の忠霊塔があっただけだったそうです。
She seems to have a long relationship with the Happy Farmer family. She said "The grandfather's wife of this family was a very pretty woman, and when we were both young, we often ate rice balls together at lunchtime of farming work, or run down at a breath from the hill of Highfield to its bottom where their house was. It was really a fun." There were no houses at that time around here, only the Oihama Higashi Elementary School (at that time, it was the Oihama Junior High School), 7 round mounds (now Oihama Higashi Elementary School's school grounds), and the Japanese-Russian War Memorial Tower in front of Highfield.
彼女は、いつもシルバーカーを押して歩いて来ます。彼女と一緒にこういう記憶や当時の風景が消えてしまうのは大変残念なことです。3K Wiffyは、せめてBlogに残しておきたいと思いました。
She always walks by pushing a silver car. It would be very disappointing that such memories and the scenery of those days would disappear with her. 3K Wiffy wanted to keep a record at least in her Blog.
Highfieldの始まりの始まり
Gaijinsanと3K Wiffyの家の前には、近隣のお年寄りが共同で耕している畑がありました。彼らは好きな時に来て、土地を耕し、苗を植えて、出来た作物を分け合ったり、いろんな野菜の作り方をお互いに伝授したり、生き生きと過ごしていました。時たま仲の良さそうな笑い声も聞こえて来て、地域のよいコミュニケーションの場になっている様子は、ほほえましいものでした。
In front of Gaijinsan and 3K Wiffy's house there was a field that senior citizens living nearby are jointly cultivating. They came when they like, cultivated the field, planted seedlings, shared the finished crops, thaught each other how to make various vegetables, and spent their lives vividly. The field was a good communication place in the area and it was a pleasure to hear their laughter from time to time.
ゲートボールもいいけど、農業の方が目的意識も持てるし、なにしろ野菜が取れるのは生産的でいいです。この地域には介護付き老人ホームもどんどん増えているのですが、介護が必要になる前のお年寄りのための場所、お年寄りの健康促進に役立ち、「自分はまだやれる」という元気をくれる場所があることも大切です。外国には、アロットメントと呼ばれる同様の場所があり、都市に住む人たちが週末に菜園を作るというライフスタイルはおしゃれと捉えられています。長寿の地域の人たちは、菜園をやっている人たちが多く、農業で足腰を鍛えているから元気なんだとも言われています。
The gate ball is not bad for communication, but agriculture has a sense of purpose, and it is anyway productive to grow some vegetables. There are more and more nursing homes in this area, but it is also important to have a place for the elderly people before they need to be cared, a place that helps to promote the health, and a place that gives them a spirit that 'they can still do it'. In western countries, there is a similar place called "allotment", and the lifestyle, where people living in the city create a vegetable garden on the weekend, is considered fashionable. People in the longevity area are said to stay healthy because they are growing a vegetable garden and training their legs in farming.
この土地は、この界隈の大地主様の持つ生産緑地でしたので、このままずっと地域のお年寄りの健康に貢献する社交場として存在すると思っていました。少なくとも生産緑地登録期間の30年間、2022年までは。でも、生産緑地化は、今の大地主様のお父さんの代で登録したことなので、その方が亡くなった後は、代替わりということで、登録を外すことが出来るそうです。で、大地主様は、お持ちの土地の半分（写真の部分）を地元の不動産屋さんに売って、住宅地として分譲されることになりました。
This land was a productive green land owned by a landlord of this area, so Gaijinsan and 3K Wiffy thought that the land would continue to be a social space that contributes to the health of the elderly people in the area. At least for 30 years, up to 2022, by the end of production green land registration period. However, the production green land had been registered at the time of the father of the present landlord. After the death of the person, it seems that it is possible to remove the registration because of change of the ownership. So, the landlord sold the half of her owned land (shown in the picture) to a local estate agency for sale as a residential area.
アロットメントが無くなるのは大変残念でした。でも、お陰でGaijinsanと3K Wiffyは、１部を買うことが出来ました。そして、無くなったアロットメントの代わりに、地域の社交場になるような、参加型の「なにか」が作れないかと模索しています。
It was very disappointing that this allotment would be lost. But thanks to this, Gaijinsan and 3K Wiffy were able to buy a part of the land. And instead of this lost allotment, they are thinking of creating a participatory "something" that will be a social space in this area.
固定資産税が来ました
先日、今年度の固定資産税の請求書が届きました。Gaijinsanと３K Wiffy、それぞれが家の周りの土地を買ったので、請求書は２通です。家の周りの土地の買い足しをしたので、住宅特例適用となって、２００㎡までは評価額の６分の１、２００㎡超えの部分は評価額の３分の１が課税評価額になるはずです。でも、・・・なっていませんでした。地目は「介在畑」で、評価額の７０％が課税評価額となっていました。
Bills for property tax of this year have arrived. Gaijinsan and 3K Wiffy, each bought lands around the house, so there were two bills. As the lands were additional to their house, they should apply for the special measures; up to 200 ㎡, the taxable valuation would become one-sixth of the evaluation value, and after 200 ㎡, the taxable valuation would become one-third of the evaluation value. But ... not. The land category was "field", and 70% of the evaluation value was the taxable valuation.
C市の土地の資産税課に確認すると、「今年１月頭に現地調査をした際、新しく購入した土地は畑のままでしたし、宅地とはフェンスで区切られていました。１つの宅地とは確認出来なかったので、畑として評価しました。」ということでした。市街地なので、畑も宅地も評価額は変わらないそうです。ただ、今後の造成コストを考慮して、１割ばかり畑の方が安い評価になるだけだそうです。
They asked the reason to the land property tax section of local government office. The explanation was "When the field survey was conducted at the beginning of January this year, the newly purchased lands remained as field, and they were separated from the residential land by a fence. As we could not confirm as one residential land, we evaluated separately as field." As the lands are in a city area, a field or a residential land does not change in value. However, in consideration of the future cost, in case of field, the land value is estimated about 10% (only) cheaper.
Gaijinsanの土地は、コミュニティのお年寄りからの要望で、昨年１２月末までは畑のままにしておいてあげました。３K Wiffyの土地は、その土地を借りて農業をしていたHappy Farmer家族への配慮で、１年間そのまま耕作してもらう約束にしています。役所の人に事情を説明しましたが、現況重視だそうで、そうした配慮などは税金に考慮できないそうです。ただ、土地の登記の際に番地を１つに統合して合筆登記していたら、１つの宅地として見ていただろうということでした。１つの宅地として評価されていたら、固定資産税は５万円ばかり安かったそうです。
The Gaijinsan's land was left as field until the end of December last year. It was a request by the elderly people in the community, who were tenant farmers. The 3K Wiffy's land was promised to remain as it is for a year. It was a consideration for Happy Farmers' family who has been renting the land for farming. I explained the circumstances to the officer of tax section, but he said that the current status is important, and any consideration for these 'kind' acts can not be taken into account for tax calculation. However, he said that it would have been seen as one residential land if the address numbers were integrated at the registration of the lands. The property tax would have been 50,000 yen cheaper in that case.
来年も５万円余計に税金を払わないために、来年の１月の調査までに、がんばって庭作りをしないといけません。
Gaijinsan and 3K Wiffy must do their best to create a garden by the survey in January next year so that they we will not need to pay the extra 50,000 yen tax next year.
