Happy Farmer一家（その後）

Happy Farmer一家には、農業委員会も認めているので、「元には戻せない」ということは理解してもらえました。Gaijinnsanと3K Wiffyの不動産屋さんも、登記も済ませているのだからと、説得にがんばってくれました。交渉を重ねるうちに、Happy Farmer一家のぐずりもだんだん理由がはっきりしてきて、それをまとめた交換条件が出て来ました。「Highfieldの南側の5m幅の購入した土地の代わりに、その部分の1.5倍の大きさの土地を西側の購入地にプラスするので、交換して欲しい。」というものでした。南側の土地は、トラクターの進入に使うのでキープしておきたいという理由です。

As the agricultural committee approved the purchase, the Happy Farmer Family understood that it could not be undone. The estate agency of Gaijinnsan and 3K Wiffy  also tried to persuade the Happy farmers that we have officially registered the land. As the negotiations progressed, the reasons of Happy Farmers' dissatisfaction became more clear, and the terms and conditions for exchange came out; which was "Instead of the purchased land on the south side of Highfield (5m wide, 13m long), they want to replace it with a Land of 1.5 times in size on the west side." The land on the south side was used for the approach of their tractor, so they wanted to keep it.

でもこの交換売買は、この土地の緑地制限の30年の期限が終わる4.5年後先にしか実現出来ないのです。この緑地制限は、大地主様のお父様の代にC市に登録したことですが、一旦、代変わりを理由にアロットメントの側とGaijinnsanと3K Wiffyの買ったHappy Farmer一家の耕作地の端っこの部分は緑地制限を外したので、残った他の土地は、もう期限の終わりまで動かせません。この交換条件を呑めば、Gaijinsanと3K Wiffyは、4.5年間、土地の造成は一切出来ず、ただ交換を待たなくてはならなくなります。4.5年は長いです。

But this exchange can only be realized 4.5 years after at the end of the 30-year period of production green land restriction. This production green land was registered with C-city at the father's generation of the landlord. Once, for the reason of generation change, this restriction was removed for the allotment side and for the edge of the Happy Farmers's side, which was bought by Gaijinnsan and 3K Wiffy. So, the restriction for remaining land can not be removed until the end of the period. If Gaijinsan and 3K Wiffy agree to this exchange, they will not be able to do any land forming for 4.5 years. 4.5 years are long just to wait.

しかし、納得してもらうためには、譲歩も必要です。ただ、3K Wiffyは、南側は、特に土地が狭く、家と畑の間が数十センチしかないので、せめて1.5mくらいはこのまま確保したいと思いました。5mから1.5m引いて、3.5mの幅になっても、トラクターは進入出来ることを確認しました。こちらのこの1.5m条件を呑んでくれるなら、交換まで待ってもよいと歩み寄りましたが、Happy Farmer一家は、どうしても南側は全部欲しいと譲りませんでした。

Anyway, a compromise is also necessary in order to convince the Happy Farmer Family. But, 3K Wiffy wanted to keep at least 1.5m at the south side. On the south side, the Highfield land is particularly narrow, with only a few dozen centimeters between the house and the field. She checked that a tractor could enter even if it became 3.5m width by subtracting 1.5m from 5m. If the Happy Farmers leave 1.5m wide land for her, 3K Wiffy thought that she could wait until the exchange. But, the Happy Farmers did not agree to this and insisted all south side.

土地の人たちから話を聞くと、このHappy Farmer一家は、地元でも傍若無人な迷惑行為で有名な農家でした。この地域に点在する畑で耕作していて、畑の周辺の人たちから、「トラクターでフェンスを壊されたが、何もしてくれず、結局自分で直した。」とか、「畑の隣の空き地に勝手に工作機械を置いておく。」とか「朝６時から、トラクターを運転するので、睡眠妨害だ。」とか「収穫した後のキャベツやブロッコリーをそのままにしているので、腐ってひどいにおいがする。」という苦情を聞いています。

According to the local people, this Happy Farmer family was famous for being arrogant and annoying. They cultivate the fields scattered in this area and people complain; "The Happy Farmers broke my fence with a tractor, but they didn't do anything and eventually I fixed it myself.", "The Happy Farmers keep the tractors on the vacant land next to the field without permission.", "The Happy Farmers drive the tractor from 6 am. It is a sleep disturbance.", and "As The Happy Farmers leave cabbages and broccolies after harvest, those vegetables become rotten and smell awfully."

また、Happy Farmer一家の交換条件は、彼らが大地主様より交換分の土地を4.5年後に購入して、始めて成立するのですが、その購入費用の出所が、当てにならないこともわかって来ました。交換条件で、期限を引き延ばし、その間自由に使って、4.5年先が来たら、またぐずぐず言い出す可能性も出て来たのです。

Also, the terms of exchange with the Happy Farmer family will come true when they purchase the land for the exchange from the landlord after 4.5 years. But we are informed that their source of the purchase cost is not very reliable. There was a possibity that the Happy Farmers extend the time limit with the terms of the exchange, while using the land freely, and 4.5 years later, they say difficulties again.

Gaijinnsanと3K Wiffyは、当てにならない話に振り回されるのは嫌なので、交換条件は受け付けないことに決めました。

Gaijinnsan and 3K Wiffy decided not to accept the terms of the exchange, as they do not want to be swayed by unreliable promises.

しかし、Happy Farmer一家はぐずぐず言い、新しく設置されていた境界の杭も抜いてしまう始末でした。刑法には「境界標を損壊し、移動し、若しくは除去し、又はその他の方法により、土地の境界を認識することができないようにした者は、5年以下の懲役又は50万円以下の罰金に処する」となっています。このため一旦は、裁判所による調停、Happy Farmer一家が調停に出てきてくれなければ裁判にする、という話にもなりました。費用は、不動産屋さん持ちです。（Happy Farmer一家との決着については、3K Wiffyが土地の購入契約に記載してもらっていました。）Gaijinnsanと3K Wiffyは、弁護士さんにも会って、裁判の準備をしていました。裁判になれば、こちらの勝訴は間違いありません。

However, the Happy Farmer family still complained and even pulled out the newly installed boundary mark stakes of 3K wiffy's purchased land. It is supposed to be treated, according to the Penal Code, "those who have broken, moved or removed border marks, or otherwise made them unable to recognize land boundaries are subject to five years in prison or a fine of up to 500,000 yen." Gaijinnsan and 3K Wiffy decided to go for the court mediation, and if the Happy Farmers do not appear in the mediation, go for the court trial. The expenses are promised by the estate agency. (3K Wiffy asked to state in the land purchase contract about the settlement with the Happy Farmer family.) Gaijinnsan and 3K Wiffy met a lawyer and were preparing for the trial. If we go to the trial, there is no doubt that we will win this case.

が、不動産屋さんが、昔からここにいる家族だからと、またがんばって仲裁してくれて、結局裁判にかかる分くらいのお金を包むことで、解決となりました。

But, the estate agency continued to do their best, as the Happy Farmer Family is an old family here. In the end, it was settled by giving them some money. The amount was about the cost for the trial.

Gaijinnsanと3K Wiffyは、購入した敷地を造成出来ることになりました。明日6月25日から造成に入ります。Happy Farmer一家にも伝えて、期日までに、廃材の片づけ、作物の収穫、置きっぱなしのトラクターの移動をお願いしました。

Gaijinnsan and 3K Wiffy is now able to do the land forming on the purchased land. It will start tomorrow on June 25. The Happy Farmer Family was informed the date and asked to clean up the waste, harvest the crop and move the tractor by the due date.

でもHappy Farmer一家は、廃材は片づけないし、いまだトラクターは置きっぱなしにしています。とうもろこしだけ、収穫に来ました。

But, the Happy Farmer family did not clean up the waste. The tractor is still in place. They have only come to harvest the corn...

明日はどうなるのでしょうか？
